Characteristics of a right to a healthy environment in the Ecuadorian Contitution

The aim of this article was to analyze the right of people to a healthy and ecologically balanced environment established in the Constitution of Ecuador, which allowed us to know its true legal nature within national law and as an emblematic institution of the Ibero-American constitutions. In this sense, this documentary work used a qualitative approach and a level of explanatory depth, the importance of which was evidenced in the legal range of the right to a healthy environment within the aforementioned legal system. In any case, the right to a healthy environment was considered a human right of enjoyment, both individually and collectively. Consequently, in light of the normative method and its quality of enjoyment, it is a subjective right, whose characteristic has been recognized in both national and international law.
